“双循环”新发展格局在发力

——以2020年10月15日《国务院关于同意在浙江省暂时调整实施有关行政法规规定的批复》为视角

Overview

The State Council of the People’s Republic of China has issued a circular on the approved temporary adjustment to some relevant administrative rules in Zhejiang Province on October 15, 2020. According to the official release, the administrative rules mentioned above "pertain to marriage registration, management of equality, survey and design in construction projects, and drug administration".

2020年10月15日，中华人民共和国国务院发布关于同意在浙江省暂时调整实施有关行政法规规定的批复。根据官方报道，上述行政法规“涉及婚姻登记、平等管理、建设工程勘察设计、药品管理”领域。

After the tweaks, natural persons, legal persons and other organizations in Zhejiang will embrace a less-restrictive, more simplified and more friendly administrative management mechanism in these fields in Zhejiang and beyond. 

More specifically, mainland couples will be temporarily allowed to choose a marriage or divorce registration authority across Zhejiang Province voluntarily instead of the only one that holds their household registration, to handle marriage and divorce procedures, if either or both parties of the marriage relationship are habitual residents in Zhejiang Province. 

This move effectively puts Zhejiang Province in the national sea of human beings as the trial location for less restrictive (i.e., more freedom) places of choices for marriage relationship in China.

本次调整实施后，浙江省的自然人、法人和其他组织将在上述领域迎来更加灵活、便利和友好的行政管理体制。

具体而言，男女一方或双方常住户口所在地在浙江省的内地居民，可以暂时在浙江省内自主选择婚姻登记机关办理结婚、离婚登记。

实际上，这表明浙江省将作为未来我国婚姻登记制度实现更加便利和自由的改革试点。

In relation to construction management, Zhejiang Province is temporarily authorized to carry out classified management of construction drawing design documents, exempting those in low-risk projects from administrative review. This expects to gradually change the market for architectural design for buildings and structures in Zhejiang Province in the years to come.

To set up businesses engaging in drug wholesale and retailing in Zhejiang Province, applicants do not need regulatory approval for start-up preparations temporarily. This move will, particularly in the Covid-19 era, likely encourage investment in drug wholesale and retailing businesses in Zhejiang, where less administrative restriction to market access but more post-supervision is set in place for wholesale and retail of drugs in the domestic market.

在建设工程管理方面，国务院同意授权浙江省暂时对施工图设计文件实行分类管理。经评估的低风险项目可免于行政审查。这有望在未来几年内逐步改变浙江省建筑物和构筑物的建筑设计市场。

在浙江省内开办从事药品批发、药品零售的企业的申请人将暂时不需要经过药品监管部门的筹建审批。在新冠肺炎疫情的背景下，减少国内市场准入限制并加强事后监管，将会极大地拉动和促进药品批发和零售企业在浙江省的投资。

At the time of a period of dramatic global change that is rarely seen in a century, by these tweaks, the Central Government has bravely taken assertive action to follow the "dual circulation" development pattern in which domestic economic cycle expects to play a leading role while international economic cycle remains its extension and supplement. 

Great importance should be attached to the institutional guarantees, which calls for efforts to work on a more flexible policy system and a more scientific management system. It is noted that these tweaks to administrative rules are consistent with the spirit of streamlining government and delegation of authorization to local governments in administrative matters, which creates a trial implementation of releasing authorizations for local needs, and more importantly, it can be considered a starting point for law and rules to lead the new changes under the "dual circulation" development pattern.

身处“百年未有之大变局”，中央果敢地提出，要加快形成“以国内大循环为主体、国内国际双循环相互促进”的新发展格局。

为完善对新发展格局的制度保障，我国政府就必须在更加灵活的政策体系和更加科学的管理机制上下功夫。值得关注的是，上述调整反映了中央政府在行政管理事项上对地方政府的授权，为地方需求释放了更大的自主空间。这与近年来我国行政机关“放管服”（即简政放权、放管结合、优化服务）的改革方向是一致的。更重要的是，这可以视为构建新发展格局背景下，通过法律和规则助力变革的重要起点。

In President Xi Jinping’s speech delivered at a celebration marking the 40th anniversary of the establishment of the Shenzhen Special Economic Zone on Oct 14, 2020, he has emphasized that reform will not come to a standstill, and opening-up will only go further and in a higher level. This latest adjustment of the administrative matter is apparently "a move to deepen the reform of streamlining administration and improving government services, and create a better business environment". 

On the other hand, according to the official release, it also puts forward a higher standard for the administrative management of the related State Council departments and Zhejiang’s provincial government that they shall "align their own regulations and normative documents with the latest changes, and build supervision and management systems matching the reform".

2020年10月14日，习近平主席在深圳经济特区建立40周年庆祝大会上发表的讲话中强调，“改革不停顿，开放不止步，在更高起点上推进改革开放”。此次国务院同意在浙江省暂时调整实施有关行政法规规定，显然是“深化简政放权、改善政府服务的改革，营造更好的营商环境”的重要举措。

另一方面，这也对国务院有关部门和浙江省政府的行政管理提出了更高的要求。根据官方报道，上述行政机关要“确保现有的政府规章及其他规范性文件与本次行政法规规定调整保持一致，并构建与改革相匹配的行政监督管理体系”。
