Thesis Writing: What Is Your Question？

On the day of World Book and Copyright Day (世界读书日), Dr. Jerry Zhang, Director of Beijing Linli Law Office, coupled with Mr. Thomas Manson Q.C., an instructor from the Foreign Languages School of Peking University, upon friendly invitation from Professor Ji Ying of Law School of UIBE, conducted a dual-instructor lecture (双指导) on “Thesis Writing: What Is Your Question？” at Ningyuan Building 334, with graduate students of UIBE.

At the class, Mr. Manson shared his many years of teaching experience, as reflected in more than 60 PPT slides, that was accumulated from his teaching at FLS, and Yanching Academy of Peking University in his academic writing and critical thinking classes. From extensive reading, research of problems in a certain field to exploration and findings, Mr. Manson emphasized the details of time management, efficiency of thesis writing process and mapping models, and revising, editing, reviewing, and proof-reading processes.

在“世界读书日”当天，北京霖理律师事务所主任张玉林博士与北京大学外国语学院教师托马斯·曼森(Thomas Manson Q.C.)先生，应对外经济贸易大学法学院冀莹老师的友好邀请，于宁远楼334教室为研究生们举办了一场题为“论文写作：你提出了什么问题？(Thesis Writing: What Is Your Question)”的双指导讲座。

在课堂上，曼森先生展示了60多张幻灯片，分享了他在北京大学外国语学院和北京大学燕京学堂教授学术写作和批判性思维课程的过程中积累的多年教学经验。从广泛阅读、研究某一领域的具体问题，到深入探索并得出结论，曼森先生强调了时间管理的各个细节以及论文写作过程中的效率问题，介绍了论文导图模型，并对修改、编辑、审阅和校对过程进行了细致的讲解。

As a thesis writing case study, Dr. Zhang shared his personal experience of how he completed his LLM thesis on the topic of “International Arbitral Jurisdiction” at UBC Law in 1994. Thanks to the excellent supervision he had from his supervisors, he was able to research into the field of international commercial arbitration, and examined the question whether international commercial arbitration had developed into a system of jurisdiction free of court control. In answering this question, his thesis states that international commercial arbitration was benefited by the principle of maximization of party autonomy and minimization of court intervention that was originated from the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958 (New York Convention) and enshrined in the UNCITRAL Model Law of 1985. In the lecture, Ms Wang Wenqian, a graduate student from MTI program of SIS UIBE stood to tell a case (Belokon v Kyrgyz Republic 2015 ONSC 5918 (CanLII)) where the court rejected the application to re-visit the facts of the case in the enforcement proceedings in Toronto, Ontario when the Respondent wanted to re-open the merits of the case at the time. The gist of the relationship between the court and international arbitration is that the court respects the findings of the arbitrators on the merits or substance of the case, and will only review the procedural aspect of the arbitration case, in enforcement proceedings.

作为论文写作案例，张玉林博士分享了他于1994年在英属哥伦比亚大学法学院完成法学硕士论文的个人经历。该论文的主题是“国际仲裁的管辖权”。在导师的出色指导下，张博士得以对国际商事仲裁开展研究，并探讨了国际商事仲裁是否已经发展成为一种不受法院干预的管辖体系这一问题。在回答该问题时，张博士的论文指出，国际商事仲裁受益于当事人意思自治最大化和法院干预最小化的原则，该原则确立于1958年《联合国承认及执行外国仲裁裁决公约》（纽约公约），并于1985年《联合国国际贸易法委员会国际商事仲裁示范法》中得到体现。在讲座上，对外经济贸易大学英语学院MTI项目研究生王文倩同学分享了一个案例（Belokon v Kyrgyz Republic 2015 ONSC 5918 (CanLII)）。本案中，在加拿大安大略省多伦多市的仲裁裁决执行程序中，被申请人试图重启对案件实质问题的审理，但是法院驳回了重新审查案件事实的申请。法院和国际仲裁二者关系的要点在于，法院尊重仲裁员对案件案情或实质问题的调查结果，且在执行程序中，法院只审查仲裁案件的程序性问题。

The instructors note jointly that essay writing requires diligence in extensive reading, literature review, preparation of outlines, interaction with supervisors, drafting, revision and editing, and finally referencing and acknowledgements. Risks of academic plagiarism must be avoided, and fair competition in writing good essays should be noted.

两位导师共同指出，论文写作需要我们勤勉细致，广泛阅读、撰写文献综述、拟出大纲并与导师交流，然后经历起草、修改和编辑等过程，最终完成引证和致谢部分。论文作者一定要避免任何学术抄袭的风险，在写好论文的同时注意公平竞争。

The dual-instructor class was well received from the students on site as well as dozens of participants on-line from outside the university. It is noted that dual instructor could be encouraged from time to time in law and other social science or natural science seminars so as to encourage and promote interactions among instructors and students.

这场双指导讲座受到了来自现场学生以及数十名线上参与者的好评。在法律及其他社会科学或自然科学的研讨会中，可以不时采取双指导制，以鼓励并促进导师和学生之间的互动。
