International Commercial Arbitration
Arbitration, an ancient method of dispute resolution. When two parties are in dispute, they agree to invite a third person to make an adjudication. The third person is usually a respected elder who hears the opinions of both sides and adjudicate impartially.
Arbitration is a civil dispute resolution procedure that deals with contractual or non-contractual civil and commercial disputes among civil and commercial entities. Arbitration institutions are folk institutions rather than government organizations, or courts supported by national public resources . China’s arbitration system was established on the Arbitration Law, which was passed on August 31, 1994, and came into force on September 1, 1995，and constantly evolves with time, through judicial interpretations.
Compared with international litigation, international commercial arbitration has become a popular choice for commercial entities because of its confidentiality and the broader autonomy of its parties. Moreover, the extensive application of the United Nations Convention on Recognition and Enforcement of Foreign Arbitral Awards (the “New York Convention”) also provides an effective and secured system for the recognition and enforcement of international arbitration awards abroad. In international arbitration, choosing the right attorney or arbitrator is of great significance for the effective resolution of disputes.
